The recent loss of the symbolic 'bat' not only effectively sidelines the Pakistan Tehreek-e-Insaf (PTI) in the electoral arena but also potentially closes the doors of parliamentary politics for the party in the post-election landscape.

With the party now without its election symbol, several independent candidates, previously affiliated with the PTI but denied party tickets, are running their campaigns as candidates endorsed by Imran Khan.

However, under Rule 94 of the Election Rules 2017, independent candidates can only align with a political party that has been issued an election symbol by the Election Commission of Pakistan (ECP).

This means that even if successful, independent candidates associated with PTI cannot rejoin the party due to constitutional constraints.

Former provincial minister and independent candidate Taimur Saleem Jhagra acknowledged the constitutional limitations but suggested the exploration of alternative options. "We cannot go against what the constitution says and what is in the rules," he stated. Nevertheless, PTI is considering potential avenues, including the possibility of approaching the courts. "The party is also focusing on its intra-party elections," he added.

On the flip side, PTI supporters are compelling independent candidates endorsed by PTI to pledge allegiance on the Holy Quran to remain loyal to Imran Khan and the party. This further complicates the political predicament for the former ruling party.

‘Devil is in the details’

Section 94 of the Election Rules 2017 stipulates that an independent candidate must declare their affiliation with a political party within three days.

However, the challenge lies in the definition of a political party, as per the same rule, which necessitates the party to be allocated an election symbol by the ECP.

“For the purpose of this rule, the expression 'political party' means a political party to which a symbol has been allocated by the Commission,” reads Section 94 of the Election Rules 2017.

Since PTI's symbol has been revoked, independent candidates are barred from rejoining the party.

An ECP senior official confirmed that, according to election rules, an independent candidate can only join a political party issued an election symbol by the commission.

Efforts to obtain further comments from an ECP spokesperson were unsuccessful.

The significant setback occurred earlier this month when the Supreme Court overturned the Peshawar High Court's decision to reinstate the bat as PTI's symbol for the general elections.

This legal setback dealt a severe blow to PTI's electoral aspirations, leading to accusations from the party that the decision aims to sideline it from the impending ballot.

The verdict left PTI's ticket holders with the unusual task of contesting as independent candidates. The party's attempt to align with the PTI-Nazriati splinter group, with the batsman symbol, also faced hurdles as agreements unraveled.

On December 22, the ECP, on technical grounds, omitted PTI's bat symbol, citing the party's failure to conduct intra-party elections as mandated by law.

In anticipation of the polls, party leaders and social media activists are diligently working to identify these candidates, ensuring clarity for party voters. Additionally, the party has established a dedicated "PTI’s Elections 2024 portal for candidates," featuring the names and symbols of its endorsed candidates.

However, numerous voters attempting to access Insaf.pk/elections2024 reported encountering issues with the non-functional link.

اب حزب بغیر اپنے الیکشن سمبل کے ہے، کئی انڈیپینڈنٹ کینڈیڈیٹس جو پہلے پی ٹی آئی سے جڑے ہوئے تھے مگر پارٹی ٹکٹ سے محروم ہوگئے ہیں، اب عمران خان کی حمایت میں اپنے حملوں کو چلا رہے ہیں۔

مگر، الیکشن رولز 2017 کے رول 94 کے تحت، انڈیپینڈنٹ کینڈیڈیٹس صرف ایک ایسے سیاسی جماعت کے ساتھ جڑ سکتے ہیں جسے الیکشن کمیشن آف پاکستان (ای سی پی) نے ایک الیکشن سمبل دیا ہو۔

یہ یعنی کہ کامیاب ہونے کے باوجود، پی ٹی آئی سے منسلک انڈیپینڈنٹ کینڈیڈیٹس اس وقت تک پارٹی میں واپس نہیں جا سکتے جب تک آئینی رکاوٹوں کا سامنا ہو رہا ہے۔

سابق صوبائی وزیر اور انڈیپینڈنٹ کینڈیڈیٹ تیمور سلیم جھگڑا نے آئینی حدودوں کو تسلیم کیا لیکن ممکنہ ذرائع کے تجاوز کی ہم طرف نشان لگایا۔ "ہم آئین کی باتوں اور قوانین کی باتوں کے خلاف نہیں جا سکتے،" انہوں نے کہا۔ معاونے میں، پی ٹی آئی مختلف ذرائع پر غور کر رہا ہے، جو کہ عدلیہ کی طرف جانے کا امکان بھی شامل ہے۔ "پارٹی اپنے اندرونی انتخابات پر بھی توجہ دے رہی ہے،" انہوں نے شامل کیا۔

اچھا، یہ کہ پی ٹی آئی کا سمبل چھین لیا گیا ہے، انڈیپینڈنٹ کینڈیڈیٹس کو پارٹی سے واپس جوڑنے کا امکان نہیں ہے۔

یہ بڑی نقصان یہاں آیا جب عدلیہ نے اس مہینے کے شروع ہونے سے پہلے پشاور ہائیکورٹ کے فیصلے کو برطرف کرتے ہوئے پی ٹی آئی کو عام انتخابات کے لئے بیٹ کو دوبارہ قائم کرنے پر معطل کر دیا۔

اس قانونی دھکا پی ٹی آئی کے انتخابی امکانات پر ایک شدید ضرب ہے، جس نے حزب کو الزامات لگائے کہ فیصلہ اسے مستقبل کے بلوط سے ہٹانے کا منصوبہ رکھتا ہے۔

اس فیصلے نے پی ٹی آئی کے ٹکٹ ہولڈرز کو انڈیپینڈنٹ کینڈیڈیٹس کے طور پر متسلسل کرنے کا عجیب وظیفہ دیا۔ حزب کی کوشش کے باوجود کہ پی ٹی آئی-نظریاتی ٹکڑے کے ساتھ ملانے کی کوششیں ہو رہی تھیں، جس میں بیٹسمین سمبل تھا، ایگریمنٹس ٹوٹ گئیں۔

عدلیہ نے 22 دسمبر کو، قانون کے مطابق، پی ٹی آئی کے اندرونی انتخابات کا انعقاد نہ ہونے کی بنا پر حزب کے بیٹ سمبل کو تشہیری مقدمے سے نکال دیا۔

انتخابات کی توقعات کے لئے، حزب کے رہنماؤں اور سوشل میڈیا ایکٹوسٹس محنت کر رہے ہیں تاکہ یہ کینڈیڈیٹس کو پہچانا جا سکے اور پارٹی ووٹرز کے لئے وضاحت ہو۔ علاوہ ازیں، حزب نے اپنے "پی ٹی آئی کے انتخابات 2024 کے پورٹل فار کینڈیڈیٹس" کو قائم کیا ہے جس میں اس کے اینڈورسڈ کینڈیڈیٹس کے نام اور سمبل شامل ہیں۔

مگر، Insaf.pk/elections2024 کا غیر فعال ہونے کا شکایت کرنے والے بہت سے ووٹرز نے غیر فعال لنک کے ساتھ مصروف ہونے کی شکایت کی ہے۔
