ISLAMABAD: Former Punjab chief minister and PTI leader, Parvez Elahi, has taken his case to the Supreme Court following the rejection of his nomination papers for the upcoming general elections. Elahi, currently in detention at Rawalpindi’s Adiala Jail, submitted his nomination papers for three National Assembly constituencies (NA-59, NA-64, and NA-69) and four Punjab Assembly constituencies (PP-23, PP-34, PP-32, and PP-42). However, his papers were rejected by various returning officers (ROs).

Displeased with the ROs' decision, Elahi appealed to an election tribunal, which upheld the ROs’ verdict. Subsequently, he approached the Lahore High Court (LHC), where a three-member bench on January 13 upheld the tribunal's order.

The PTI central president has now filed an appeal against the LHC verdict in the Supreme Court, naming the Election Commission of Pakistan (ECP) and the election tribunal as respondents, and requesting the SC to nullify the LHC decision.

One objection to his candidacy revolves around his alleged shares in Lahore Modern Flour Mills. Elahi dismissed this claim, asserting that no bank account has been opened in the name of the mills, and he has never purchased shares in the inactive flour mill, which should not be considered an asset impacting his eligibility for the election.

Elahi argued that disqualifying a candidate based on the omission to mention one of his assets goes against established principles. He emphasized that the intention of the accused should be taken into consideration in such cases. The total value of the shares associated with the mills, he noted, amounts to Rs24,850, and he has declared total assets worth over Rs175 million, including cash exceeding Rs57 million. Elahi argued that not disclosing such ordinary shares cannot be considered dishonest.

Another objection was raised regarding his failure to declare licenses for seven firearms. Elahi pointed out that there is no column in the nomination papers for declaring weapon licenses.

In a related development, the Supreme Court dismissed the appeal of JUI candidate Abdul Hafeez Loni, upholding the verdict of an election tribunal. Loni, who had filed nomination papers from NA-252, saw his papers rejected by the election tribunal. The Balochistan High Court later upheld the tribunal’s decision, and Loni's subsequent appeal to the Supreme Court was also dismissed. The three-member bench, led by Chief Justice of Pakistan Qazi Faez Isa, maintained the tribunal's order.

اسلام آباد: سابق پنجاب چیف منسٹر اور پی ٹی آئی کے رہنما، پرویز الٰہی، نے اپنے نامزدی پر ہونے والے عام انتخابات کے لئے اپنا مقدمہ سپریم کورٹ میں دائر کرلیا ہے جس پر ان کے نامزدی کاغذات کو مسترد کر دیا گیا تھا. الٰہی، جو حال ہی میں راولپنڈی کے اڈیالہ جیل میں قید ہیں، نے تین قومی اسمبلی حلقات (NA-59، NA-64، اور NA-69) اور چار پنجاب اسمبلی حلقات (PP-23، PP-34، PP-32، اور PP-42) کے لئے اپنے نامزدی کاغذات جمع کروائے تھے. لیکن، مختلف واپسی افسران (ROs) نے ان کے کاغذات کو مسترد کردیا.

ROs کے فیصلے سے خوش نہ ہوکر، الٰہی نے الیکشن ٹربیونل کی طرف اپیل کی، جو ROs کے فیصلے کو تائید کرتے ہوئے رہا. اس کے بعد، انہوں نے لاہور ہائی کورٹ (LHC) میں جایزہ دینے کے لئے مواقعہ کی، جہاں تین ممبر بینچ نے 13 جنوری کو ٹربیونل کے فیصلے کو تائید کیا.

پی ٹی آئی کے صدر نے اب اس LHC فیصلے کے خلاف ایک ایپیل سپریم کورٹ میں دائر کی ہے، الیکشن کمیشن آف پاکستان (ECP) اور الیکشن ٹربیونل کو متعین قرار دیا ہے، اور اس نے سپریم کورٹ سے درخواست کی ہے کہ وہ LHC کا فیصلہ باطل قرار دے.

ان کی نامزدگی کے ارد گرد ایک اعتراض یہ ہے کہ ان کے ملکرے ہوئے چکیوں میں حصہ ہے. الٰہی نے اس الزام کو ناقابلِ قبول بتایا، کہتے ہیں کہ چکیوں کے نام پر کوئی بینک اکاؤنٹ نہیں کھولا گیا ہے، اور انہوں نے کبھی بھی اس غیر فعال آٹا مل میں حصے خریدے نہیں ہیں، جس کو انتخابات میں شرکت کے لئے اہل ہونے پر اثر ڈالنے والا دولت سمجھا جانا چاہئے.

الٰہی نے کہا کہ ایک اموال میں سے ایک کی بغیر ذکر کردہ کسی اہم اہمیت کے اصول کے مطابق امیدوار کو مسترد نہیں کیا جا سکتا، اور اس طرح کی صورت میں الزام عائد ہونے والے کے ارادے کو مد نظر رکھا جانا چاہئے.

انہوں نے کہا کہ چکوں سے متعلق ہونے والے حصے کی کل قدرتی قیمت Rs24,850 ہے، اور انہوں نے اپنی کل اموال کی قیمت کو Rs175 ملین سے زائد اور رقبے Rs57 ملین سے زائد دی ہے. الٰہی نے کہا کہ ایسے عام حصے کو ظاہر کرنا غیر ایماندار ہونا قابل قبول نہیں ہے.

ان کی نامزدگی کے حوالے سے ایک اور اعتراض یہ تھا کہ انہوں نے سات فائرارمز کی لائسنسز کا ذکر نہیں کیا. الٰہی نے نوٹ کیا کہ نامزدی کاغذات میں ہتھیار کی لائسنس کا ذکر کرنے کے لئے کوئی کالم نہیں ہے.

اس کے ساتھ ہی، متعلقہ ترقی کے دوران، سپریم کورٹ نے جے یو آئی کینڈیڈیٹ عبدالحفیظ لونی کی ایپیل کو رد کردیا، جس نے الیکشن ٹربیونل کی فیصلے کو تائید کیا. لونی نے NA-252 سے نامزدگی کاغذات دائر کی تھیں، لیکن الیکشن ٹربیونل نے ان کے کاغذات کو مسترد کردیا. بعد میں بلوچستان ہائی کورٹ نے ٹربیونل کے فیصلے کو تائید کیا، اور لونی نے اس کے بعد سپریم کورٹ میں ایپیل کی تھی، جسے چیف جسٹس پاکستان قاضی فائز عیسی کی سربراہی والی تین ممبر بینچ نے ٹربیونل کی فیصلے کو متعین قرار دیا.
